TERMS AND CONDITIONS

For the provision of entertainment services at Simulation Systems (Israel) Sim Dream LTD, Reg No. 516651031, hereinafter referred to as Sim Dream Israel center, on the basis of a public offer (hereinafter referred to as the Offer) for an indefinite number of capable individuals, hereinafter referred to as Customers and Visitors, to read and accept the following rules and conditions for the provision of entertainment services at the Sim Dream Israel center, located at the address: Gershon Shatz 36, Tel Aviv-Yafo.

TERMS AND DEFINITIONS

For the purposes provided by the Offer, the following terms and definitions are used:

Sim Dream Israel Center – a specially equipped room for conducting entertainment or educational sessions on flight and/or racing car simulators.

Simulator is a mobile or stationary attraction consisting of an imitation of the pilot's seat or the original cockpit of an airplane, helicopter, racing car, or a copy thereof, reproduced with the necessary accuracy, with a control such as a "stick", "Yoke" or "steering wheel", equipped with a panoramic visualization system of the external environment or virtual reality glasses and equipped with software software that simulates the operation of avionics and onboard systems of an aircraft or racing car instrumentation. The attraction is an entertainment device and is not intended to use for professional education and training purposes.

An entertainment service (hereinafter referred to as a Session) is an entertainment session on a Simulator accompanied by an Instructor.

The duration of the session is the time during which the Simulator is available to the Customer who booked the service. A initial briefing before using the Simulator is included in the total duration of the session.

The Customer is any capable individual who has accepted this public Offer by making an advance payment for Entertainment Services provided by Sim Dream Israel center in accordance with the procedure and conditions stipulated in the Offer.

A Visitor of Sim Dream Israel center is any person who is located in the premises of Sim Dream Israel center.

Payment for services is the deposit of funds to the cash desk of Sim Dream Israel center, either to a credit institution or to a payment agent engaged in accepting payments from individuals, in any way available for accepting payments by Sim Dream Israel center.

An instructor is an individual whose main function is to provide consulting assistance in managing the simulator.

Property – inventory, equipment, and machinery located on the territory of Sim Dream Israel center.

The official website of Sim Dream Israel center (hereinafter referred to as the Website) is a collection of media and information intended for publication on the Internet and displayed in certain text, graphic or sound forms. The online resource has a unique address: https://www.simdream.co.il , https://simdream.aero

The Sim Dream Israel Gift Certificate (hereinafter referred to as the Gift Certificate) is a printed document, either a plastic card, or a PDF and/or other electronic file containing the logo of Sim Dream Israel center, a unique gift certificate number, the validity period of the gift certificate with this unique number, the duration of the session and the type of Simulator, confirming the Customer's right to receive entertainment services during the validity period of the Gift Certificate without additional payment, on the terms and in accordance with the procedure provided for in this Offer. Sim Dream Israel Gift certificate may have a limit on the days of use “Only on business days”**

*Working days are determined by the work calendar approved by the Government of the State of Israel.

A gift certificate (or coupon) from a third-party organization (hereinafter referred to as a Gift Certificate), which is a printed document, a plastic card, or a PDF and/or other electronic file containing the logo or name of the organization that issued this Gift Certificate and with which the Sim Dream Israel Center has concluded a service agreement, the unique number of the gift certificate and other data required to redeem the gift certificate, the validity period of the gift certificate with this unique number, the duration of the entertainment session and the type of Simulator confirming the Customer's right to receive entertainment services during the validity period of the Gift Certificate without additional payment, on the terms and in accordance with the procedure provided for in this Offer.

The validity period of a Gift Certificate is the date after which the Gift Certificate is not valid, and the service is considered to have been provided in an undisputed manner. The validity period of the Gift certificate is specified.

The gift certificate is not a registered document and is valid for the bearer. Sim Dream Israel center is not responsible for the loss of the Gift Certificate itself or its details by the Customer.

The promotion is a special offer provided by Sim Dream Israel center to a specific Customer or an unlimited number of Customers for a specific service or services for a limited period of time under certain conditions. The promotion is a manifestation of goodwill and loyalty to Customers on the part of Sim Dream Israel center, which means that Sim Dream Israel center can cancel the promotion at any time, as well as refuse to apply the promotion to the Customer at its sole discretion.

Acceptance is the full and unconditional acceptance of the terms of this public Offer, confirmed by making a payment at Sim Dream Israel center's rates for one of the proposed Sessions on the selected type of Simulator and/or for a Gift Certificate for a Session on the selected type of Simulator.

The Privacy Policy is the procedure for processing and protecting information about individuals who are Customers of Sim Dream Israel center, published on the official websites of Sim Dream Israel center.

Tariffs (Prices) – the system of rates for payment of Gift certificates and services of Sim Dream Israel center, indicated on the official websites of Sim Dream Israel center. Sim Dream Israel center has the right to change tariffs at its own discretion at any time.

Reservation (Booking) – reservation by the Customer of the date and time of the Session in the online system of Sim Dream Israel center using the corresponding functionality of the Website of Sim Dream Israel center. The booking is confirmed by an entry in the booking system, which can be linked to the Customer's personal data.

THE MAIN PROVISIONS

This Offer defines the terms and conditions for the provision of entertainment services by Sim Dream Israel center, which include:

Conducting entertainment or training sessions on aircraft and/or racing car simulators.

Provision of a specially equipped room of Sim Dream Israel center or a certain part of it for temporary use.

Provision of temporary use of inventory, equipment, and equipment located in the premises of Sim Dream Israel center.

Other services in the manner and on the terms agreed upon by the Parties in this agreement.

The Customer undertakes to accept and pay for the above-mentioned entertainment services of Sim Dream Israel center according to the Tariffs of Sim Dream Israel center.

Additional services may be provided to the Customer by agreement of the Parties.

THE PROCEDURE FOR PROVIDING ENTERTAINMENT SERVICES

Entertainment services are provided by Sim Dream Israel center on condition of full and unconditional Acceptance of the terms of this Offer by the Customer.

To receive an entertainment service, you must pre-book a Session on the website simdream.co.il

The service must be paid for when booking online with a bank payment card and/or using a unique gift card number and/or using a unique gift certificate number.

When booking a session for a gift certificate or voucher that entitles the Customer to receive the service, the Customer must indicate the full and accurate number of such certificate or voucher in a special field. This information will be checked automatically by the system and if a certificate or coupon number is missing or incorrect, the reservation will be cancelled and the Customer will be notified about by email.

The start time for the provision of the service is the moment when the Customer takes the pilot's seat in the cockpit of the simulator and the instructor begins the initial briefing.

The Customer must arrive at Sim Dream Israel center 5 minutes before the start time of the pre-booked Session.

The Customer and/or the Visitor undertakes to use the equipment of Sim Dream Israel center carefully and according to the directions of the instructor and bears personal financial responsibility for damage to the property of Sim Dream Israel center resulting from unauthorized or careless use.

The Customer has the right to postpone the date or time of the booked Session according to the "Booking Change Rules".

The Customer has the right to refuse to receive the entertainment service and cancel the booked Session in accordance with the "Cancellation and Refund Terms".

Customers who are intoxicated and/or under the influence of medications or narcotic drugs will not be allowed to receive the service.

Children from the age of 10 are allowed to use the simulator.

The fact of booking a session on the website simdream.co.il confirms that the client has read and agreed to these rules.

BOOKING CHANGE RULES

The Customer has the right to reschedule the pre-booked Session for another day or another time if there are at least 24 hours left before the start time of the Session.

The postponement of the date or time of the provision of a pre-booked Session less than 24 hours before the start time of the Session is possible only if there is such an opportunity and is a paid service worth 150 shekels including tax.

To reschedule the date or time of a pre-booked Session, please contact us by email, phone or WhatsApp from 9:00 to 21:00 except Saturdays. If your message is received at a different time, it will be processed only at the specified hours.

CANCELLATION AND REFUND TERMS

Cancellation of the Session booking and refund is possible within 14 (fourteen) days from the date when the booking was made, but no later than 2 (two) business days before the Session should be provided.

In the case of a partial refund, for example, if the duration of the Session is reduced, the amount to be refunded is determined as the difference between the amount actually paid and the base cost of the service.

A gift card, gift voucher or certificate can be refunded within 14 (fourteen) days from the date of purchase, but no later than two (2) business days before the Session should be provided if a booking has already been made with this gift card, gift voucher or certificate.

The discount provided when purchasing a subscription is valid only if all subscription sessions are used. If the amount of a subscription is not fully used, the amount to be refunded is determined based on the nominal value of the sessions used: 30 minutes - 450 shekels, 60 minutes - 650 shekels, 90 minutes - 850 shekels.

MUTUAL RESPONSIBILITY

Sim Dream Israel center is obliged to compensate the Customer for the delay time or schedule a Session for another day without charging the booking change fee in accordance with the "Booking Change Rules" or cancel the booking and refund the Customer in accordance with his decision if the booked Session did not start on time or could not be held on the appointed day due to the fault of Sim Dream Israel center.

If the Customer is more than 10 minutes late at the start of the Session, the total Session time may be reduced by the time the Customer is late, or, at the Customer's option, the Session may be rescheduled for another date or time according to the "Reservation Change Rules".

In case of non-appearance of the Customer by the time of the booked Session, the entertainment service is considered to be fully provided and its cost is not refunded.

Customers and Visitors of Sim Dream Israel center are financially responsible to Sim Dream Israel center for any damage caused to the property of Sim Dream Israel center as a result of their careless or unauthorized actions.

SAFETY RULES

Persons under the influence of alcohol or drugs, or under the influence of medications, are prohibited from visiting the Simulator and staying on the territory of Sim Dream Israel center.

Visiting the Simulator is highly discouraged for women in late pregnancy and people with severe hypertension or problems with the vestibular apparatus.

It is possible to enter the Simulator cabin only with the permission of the Instructor or other staff of Sim Dream Israel center.

The presence of the Customer and Visitors of Sim Dream Israel center in the office and technical premises of Sim Dream Israel center is prohibited.

While staying in the Simulator cabin, the Customer and Visitors are required to follow the instructions of the Instructor.

Children from 10 to 15 years old must only be accompanied by an adult at Sim Dream Israel center.

DISCLAIMER

Sim Dream Israel center is not responsible for the deterioration of the well-being or state of health of the Customer and/or Visitor resulting due visiting the Simulator at the Sim Dream Israel center.

Sim Dream Israel center is not responsible for the deterioration of health or state of health, injury or any material damage to the Customer and/or Visitor resulting from the actions of the Customer or Visitor during a visit to the Sim Dream Israel center.

Sim Dream Israel center is not responsible for lost or unattended items.

Sim Dream Israel center is not responsible for technical inconveniences caused by seasonal, preventive and emergency work carried out by the municipal services of the city or the building in which Sim Dream Israel center is located.

Sim Dream Israel center uses email as a channel for communication and Customer information. Sim Dream Israel center is not responsible for consequences caused by the customer’s late inspection of letters from Sim Dream Israel center, as well as for the failure to receive letters from Sim Dream Israel center due to incorrect operation of spam filters or use of corporate firewalls.

Sim Dream Israel center is not responsible for any other inconveniences caused as a result of force majeure circumstances.

Sim Dream Israel center and the Customer are not responsible to each other for violating the terms of the Offer, if such violation is caused by force majeure, including: actions of government authorities, fire, flood, earthquake, other natural disasters, strikes, civil unrest, riots, any other circumstances that do not limited to the above, which may affect the fulfillment of the terms of this Offer.

Sim Dream Israel Center retains the right to use in commercial advertising, publications and on its websites photo and video materials with images of customers of Sim Dream Israel Center, received legally and with the permission of Sim Dream Israel customers during their visit to Sim Dream Israel. The presence of such photos and video material confirms that a client of the center Sim Dream Israel has provided an oral consent to carry out filming.

DISPUTE RESOLUTION

Disputes arising from the fulfillment of the terms of this Offer are resolved in accordance with the claims procedure of the current legislation of the State of Israel.

CUSTOMER'S CONSENT TO THE PROCESSING OF PERSONAL DATA

By accepting the Offer, the Customer of Sim Dream Israel center gives his consent to the processing (collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, distribution, transfer (including cross-border transfer), depersonalization, blocking, deletion and destruction) of personal data, carried out with and without use automation tools.

This consent to the processing of the Customer's personal data is valid indefinitely, and may be revoked by the Customer at any time by agreement of the Parties. In case of misuse of the provided data, the agreement is revoked by a written statement from the Customer.

OUR PRIVACY POLICY
